Welcome to REGISTERED EVIDENCE.

The terms "we", "us" and "our" refer to REGISTERED EVIDENCE. REGISTERED EVIDENCE operates this store and website, including all related information, content, features, tools, products and services, in order to provide you, the customer, with a curated shopping experience (the "Services").

REGISTERED EVIDENCE is powered by Shopify, which enables us to provide the Services to you.

These terms and conditions, together with any policies referenced herein (these "Terms of Service" or "Terms"), describe your rights and responsibilities when you use the Services.

Please read these Terms of Service carefully, as they include important information about your legal rights and responsibilities.

By visiting, interacting with or using our Services, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these Terms of Service or our Privacy Policy, you should not use or access our Services.

Nothing in these Terms is intended to exclude, restrict or modify any rights or remedies you may have under the Australian Consumer Law or any other applicable law that cannot lawfully be excluded, restricted or modified.

SECTION 1 - ACCESS AND ACCOUNT

By agreeing to these Terms of Service, you represent that you are at least the age of majority in your state, territory or jurisdiction of residence, or that you have given your consent to allow any minor dependants under your responsibility to use the Services on devices you own, purchase or manage.

To use the Services, including accessing or browsing our online store or purchasing products we offer, you may be asked to provide certain information, such as your email address, billing information, payment information and shipping information.

You represent that the information you provide is accurate, current and complete and that you have the necessary right to provide that information.

If customer accounts are made available, you are responsible for maintaining the confidentiality and security of your account credentials and for activity occurring through your account. You may not transfer, sell, assign or license your account to another person.

SECTION 2 - OUR PRODUCTS

We make reasonable efforts to represent our products accurately through descriptions, measurements, photographs, graphics and digital product renders.

However, colours and product appearance may vary depending on your screen, device settings, display configuration and other factors.

Where digital renders or mock-ups are used before physical product photography is available, they are intended to provide an accurate representation of the garment design and artwork but may not reproduce every physical characteristic of the final garment.

Product descriptions, specifications, availability and other product information may be updated from time to time.

We reserve the right to discontinue products or limit quantities offered to any person, geographic region or jurisdiction where reasonably necessary.

Nothing in this section excludes or limits any rights you may have under the Australian Consumer Law, including consumer guarantees relating to acceptable quality, fitness for purpose and correspondence with description.

SECTION 3 - ORDERS

When you place an order through our store, you are making an offer to purchase the selected products.

Your order is subject to acceptance by REGISTERED EVIDENCE. An order is not considered accepted until payment has been successfully processed and we have issued confirmation that your order has been accepted.

We reserve the right to decline or cancel an order where reasonably necessary, including where:

- a product is unavailable;
- payment cannot be authorised;
- pricing or product information contains a material error;
- we reasonably suspect fraud or unauthorised activity;
- an order breaches these Terms; or
- we are otherwise unable to fulfil the order.

If we cancel an order after payment has been received, we will provide an appropriate refund for the cancelled order.

Please review your order carefully before submitting it. Because REGISTERED EVIDENCE garments may be printed or produced after an order is placed, we may be unable to accommodate cancellation or modification requests once production has begun.

If you need to change or cancel an order, contact us as soon as possible. We will make reasonable efforts to assist but cannot guarantee that a change or cancellation will be possible.

Purchases are also subject to our Refund Policy and Shipping + Returns information.

Nothing in our cancellation, return or made-to-order policies limits your rights under the Australian Consumer Law.

Unless otherwise agreed by us, products purchased through the store are intended for personal use and not for commercial resale.

SECTION 4 - PRICES AND BILLING

Unless otherwise stated, prices displayed on the REGISTERED EVIDENCE Australian store are in Australian dollars (AUD).

Prices, discounts and promotions may change without notice. The price charged for a product will be the price displayed at the time your order is placed, subject to correction of genuine errors as permitted by law.

Any applicable shipping charges will be displayed before you complete checkout.

Where applicable, taxes will be handled and displayed in accordance with Australian law.

International shipping is not available at launch. If international shipping is introduced later, additional taxes, duties, customs charges or import fees may apply and will be addressed in the relevant shipping information.

We may occasionally offer promotions governed by additional terms and conditions. Where promotional terms conflict with these Terms in relation to that promotion, the specific promotional terms will apply to the extent permitted by law.

You agree to provide current, complete and accurate purchase, payment and account information for purchases made through our store.

You represent that you are authorised to use the payment method provided and agree to pay all charges associated with an order accepted by us.

SECTION 5 - SHIPPING AND DELIVERY

REGISTERED EVIDENCE garments may be produced or printed to order. Production therefore occurs after an order is placed rather than products necessarily being drawn from pre-printed inventory.

Production and delivery timeframes displayed by us are estimates unless expressly stated otherwise.

Once your order has been dispatched, tracking information will be provided where tracking is available.

Delivery may be affected by circumstances outside our reasonable control, including carrier delays, severe weather, natural disasters, industrial action, customs processing, incorrect delivery information or other external events.

We are not responsible for delays caused solely by events outside our reasonable control, but this does not exclude or limit any rights you may have under the Australian Consumer Law or other applicable law.

Risk in products will pass to you when the products are delivered to you or otherwise as required by applicable law.

Australian shipping rates, free-shipping thresholds and current production information are displayed on our Shipping + Returns page and/or during checkout.

SECTION 6 - INTELLECTUAL PROPERTY

Unless otherwise stated, the Services and their contents, including trademarks, brand names, logos, product names, garment graphics, artwork, text, photographs, images, graphics, video, audio, layouts and other creative material, are owned by or licensed to REGISTERED EVIDENCE and are protected by applicable intellectual property laws.

These Terms permit you to access and use the Services for personal, non-commercial purposes.

Except as permitted by law or with our prior written permission, you must not reproduce, distribute, modify, create derivative works from, publicly display, publicly perform, republish, commercially exploit, download, store or transmit substantial portions of material from the Services.

Nothing in these Terms grants you ownership of or a licence to use REGISTERED EVIDENCE intellectual property except for the limited right to access the Services in accordance with these Terms.

REGISTERED EVIDENCE names, logos, product names, designs, graphics and slogans may be trademarks or other intellectual property belonging to REGISTERED EVIDENCE or its licensors.

Shopify's name, logo, product and service names, designs and slogans are trademarks of Shopify or its related entities. Other names and marks appearing through the Services may belong to their respective owners.

All rights not expressly granted are reserved.

SECTION 7 - OPTIONAL TOOLS

We may provide access to tools, applications, integrations or services supplied by third parties.

We may not monitor or control these third-party tools.

To the extent permitted by law, third-party tools may be provided on an "as is" and "as available" basis. Your use of third-party tools may also be governed by the terms and privacy practices of the relevant provider.

You should review the applicable terms before using a third-party service.

We may introduce new features, tools or resources through the Services in the future. Unless otherwise stated, those features will form part of the Services and be subject to these Terms.

SECTION 8 - THIRD-PARTY LINKS

The Services may contain links to websites, services or materials operated by third parties.

Unless expressly stated otherwise, a link does not mean that REGISTERED EVIDENCE controls or endorses the third-party website or its content.

We are not responsible for the content, accuracy, availability, privacy practices or operation of third-party websites that are outside our control.

If you access a third-party website or purchase products or services directly from a third party, that activity may be governed by the third party's own terms and policies.

Questions or complaints relating to products or services purchased directly from a third party should generally be directed to that third party.

Nothing in this section excludes liability that cannot lawfully be excluded.

SECTION 9 - RELATIONSHIP WITH SHOPIFY

REGISTERED EVIDENCE is powered by Shopify, which enables us to provide the Services to you.

However, sales and purchases made through our store are made directly between you and REGISTERED EVIDENCE.

By using the Services, you acknowledge that Shopify provides ecommerce infrastructure and related services to REGISTERED EVIDENCE but is not the seller of REGISTERED EVIDENCE products.

To the extent permitted by applicable law, Shopify and its affiliates are not responsible for claims arising solely from products sold directly by REGISTERED EVIDENCE.

Nothing in this section excludes or limits rights or liabilities that cannot lawfully be excluded or limited.

SECTION 10 - PRIVACY POLICY

Personal information collected through the Services is handled in accordance with our Privacy Policy, available through the Privacy Policy link on our website.

Because the Services are hosted by Shopify, Shopify may collect and process personal information relating to your access to and use of the Services in order to provide its services.

Information submitted through the Services may be processed by Shopify and other service providers, including providers located outside Australia.

Please review our Privacy Policy for information about how personal information is collected, used, disclosed and protected, and how you may contact us regarding privacy matters.

Shopify's own privacy practices are governed by its applicable privacy policies.

SECTION 11 - FEEDBACK

If you voluntarily submit ideas, suggestions, feedback, reviews, comments, proposals or other content to REGISTERED EVIDENCE ("Feedback"), you grant us a non-exclusive, worldwide, royalty-free licence to use, reproduce, adapt, publish, distribute and display that Feedback for purposes connected with operating, improving and promoting REGISTERED EVIDENCE and the Services, subject to applicable law.

You represent that you have the necessary rights to submit the Feedback and that your Feedback does not unlawfully infringe the rights of another person.

If you have received compensation or another incentive in connection with Feedback or a review, you must disclose that relationship where required by law.

We may moderate or remove Feedback where we reasonably believe it is unlawful, defamatory, abusive, misleading, infringing, fraudulent, obscene, malicious or otherwise inconsistent with these Terms.

You must not submit Feedback containing malicious software, impersonate another person or misrepresent the origin of Feedback.

You remain responsible for Feedback you submit.

SECTION 12 - ERRORS, INACCURACIES AND OMISSIONS

Occasionally, information available through the Services may contain typographical errors, inaccuracies or omissions relating to matters such as product descriptions, pricing, promotions, shipping charges, production times, transit times or availability.

We may correct errors, inaccuracies or omissions and update information where reasonably necessary.

If a material error affects an order you have already placed, we will deal with the order in accordance with applicable law, including by contacting you and, where appropriate, offering correction, cancellation or refund.

Nothing in this section limits your rights under the Australian Consumer Law.

SECTION 13 - PROHIBITED USES

You may use the Services only for lawful purposes.

You must not use the Services:

(a) for an unlawful, fraudulent or malicious purpose;

(b) to violate applicable laws or regulations;

(d) to harass, threaten, abuse, defame or unlawfully harm another person;

(e) to knowingly transmit false, deceptive or misleading information;

(f) to distribute malware, viruses or other harmful code;

(g) to send spam, phishing communications or other unauthorised solicitations;

(h) to impersonate another person or entity;

(i) to obtain or attempt to obtain unauthorised access to the Services, accounts or systems;

(j) to interfere with or circumvent security, authentication or access-control measures;

(k) to unlawfully collect or track personal information belonging to others; or

(l) to reproduce, scrape, extract, sell, resell or commercially exploit substantial portions of the Services or their content without permission, except where such activity cannot lawfully be prohibited.

We may suspend or restrict access to the Services where we reasonably believe these Terms have been materially breached or where necessary to protect REGISTERED EVIDENCE, customers, Shopify or other users.

SECTION 14 - AUTOMATED AGENTS

If you use software, automated systems or autonomous or semi-autonomous agents ("Agents") to interact with the Services, you must do so lawfully and in accordance with any technical access requirements applying to the Services.

Agents must not:

(a) conceal or intentionally misrepresent their automated nature where identification is required;

(b) circumvent CAPTCHAs, access controls, rate limits or other technical measures intended to control automated access;

(d) obtain unauthorised access to data or systems; or

(e) use the Services in a way otherwise prohibited by these Terms.

We may use reasonable technical measures to restrict automated access where necessary to protect the Services, customers or our systems.

SECTION 15 - TERMINATION

You may stop using the Services at any time.

We may suspend or terminate your access to all or part of the Services where reasonably necessary, including where you materially breach these Terms, misuse the Services, engage in fraudulent activity or create a security or legal risk.

Termination does not affect rights or obligations that arose before termination.

Provisions which by their nature are intended to continue after termination, including provisions concerning intellectual property, liability, privacy, governing law and outstanding payment obligations, will continue to apply.

SECTION 16 - CONSUMER GUARANTEES AND DISCLAIMER OF WARRANTIES

Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy conferred by the Competition and Consumer Act 2010 (Cth), including the Australian Consumer Law, or any other applicable law where doing so would be unlawful.

Our goods come with guarantees that cannot be excluded under the Australian Consumer Law.

You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage.

You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.

Subject to those rights and to the maximum extent permitted by law, we do not guarantee that the website will always be uninterrupted, completely secure or error-free.

Information provided through the Services is general information and should not be relied upon as professional, technical, safety or trade advice.

REGISTERED EVIDENCE garments are off-duty apparel and are not protective workwear or personal protective equipment (PPE) unless a product is expressly described otherwise.

SECTION 17 - LIMITATION OF LIABILITY

Nothing in these Terms excludes, restricts or modifies liability, consumer guarantees, rights or remedies that cannot lawfully be excluded, restricted or modified under the Australian Consumer Law or other applicable legislation.

To the maximum extent permitted by law, REGISTERED EVIDENCE will not be liable for indirect, incidental, special or consequential loss arising from your use of the Services where such loss was not reasonably foreseeable or where liability may lawfully be excluded.

Where liability can lawfully be limited, our liability will be limited to the extent permitted by applicable law.

Nothing in these Terms is intended to exclude liability for reasonably foreseeable loss or damage where applicable consumer law requires us to compensate you for that loss or damage.

SECTION 18 - INDEMNIFICATION

To the extent permitted by law, you agree to indemnify REGISTERED EVIDENCE against reasonable losses, liabilities, damages and costs arising directly from:

(a) your material breach of these Terms;

(b) your unlawful use of the Services;

(d) fraudulent, malicious or intentionally harmful conduct by you.

This indemnity does not apply to the extent that a loss was caused or contributed to by REGISTERED EVIDENCE, Shopify or another party for whom you are not legally responsible.

Nothing in this section limits any rights you have under applicable consumer law.

SECTION 19 - SEVERABILITY

If any provision of these Terms is determined to be unlawful, invalid or unenforceable, that provision will be interpreted or severed to the minimum extent necessary while the remaining provisions continue in effect, to the extent permitted by law.

SECTION 20 - WAIVER; ENTIRE AGREEMENT

A failure by us to exercise or enforce a right under these Terms does not constitute a waiver of that right.

These Terms, together with policies and other terms expressly incorporated by reference, constitute the agreement between you and REGISTERED EVIDENCE regarding your use of the Services, subject always to rights and obligations imposed by applicable law that cannot be excluded.

Nothing in these Terms excludes representations, guarantees or rights that cannot lawfully be excluded.

SECTION 21 - ASSIGNMENT

You may not transfer or assign your rights or obligations under these Terms without our prior written consent, except where applicable law provides otherwise.

We may transfer or assign our rights or obligations in connection with a legitimate sale, transfer, restructuring or operation of the business, provided that doing so does not unlawfully reduce your rights.

SECTION 22 - GOVERNING LAW

These Terms and any dispute relating to the Services are governed by the laws of Queensland, Australia, and applicable laws of the Commonwealth of Australia.

Subject to any rights you have to bring proceedings in another jurisdiction under applicable law, the parties submit to the jurisdiction of the courts of Queensland and courts entitled to hear appeals from those courts.

Nothing in this section limits any rights or remedies available to consumers under the Australian Consumer Law or other applicable legislation.

Headings are included for convenience only and do not limit or otherwise affect the interpretation of these Terms.

We may update these Terms from time to time to reflect changes to our business, Services, legal obligations or operating practices.

Where required by applicable law, we will provide notice of material changes.

Changes will apply from the effective date of the updated Terms and will not retrospectively remove rights that have already arisen.

Your continued use of the Services after updated Terms take effect constitutes acceptance of those Terms to the extent permitted by law.
